Terms & Conditions
1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Barela Defense Group LLC ("BDG," "we," "our," or "us"), a Colorado limited liability company located at 10220 Dunsford Drive, Lone Tree, Colorado 80124. By accessing our website, placing an order, or purchasing any product, you agree to be bound by these Terms in their entirety.
If you do not agree with any part of these Terms, you must not use our website or purchase our products. We reserve the right to modify these Terms at any time. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
2. Age Requirements & Eligibility
You must meet the following minimum age requirements to purchase from Barela Defense Group LLC:
- Handguns and handgun ammunition: You must be at least 21 years of age.
- Long guns (rifles, shotguns) and long gun ammunition: You must be at least 18 years of age.
- Accessories and non-firearm parts: You must be at least 18 years of age.
By placing an order, you represent and warrant that you meet the applicable age requirement. We reserve the right to cancel any order where age verification cannot be confirmed. False representation of age is a violation of federal and state law.
3. Legal Compliance & Prohibited Persons
3.1 Federal Law
All firearm purchases are subject to the Gun Control Act of 1968, the National Firearms Act, and all applicable federal regulations administered by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). By purchasing a firearm, you represent and warrant that you are not a prohibited person as defined under 18 U.S.C. § 922(g), including but not limited to:
- Any person convicted of a crime punishable by imprisonment for more than one year
- Any person who is a fugitive from justice
- Any person who is an unlawful user of or addicted to any controlled substance
- Any person adjudicated as mentally defective or committed to a mental institution
- Any alien illegally or unlawfully in the United States
- Any person dishonorably discharged from the U.S. Armed Forces
- Any person subject to certain domestic violence restraining orders
- Any person convicted of a misdemeanor crime of domestic violence
3.2 Colorado State Law
Colorado requires a background check on all firearm transfers, including private sales. All firearm purchases facilitated by BDG are subject to Colorado law, including C.R.S. § 18-12-112 (background check requirements) and all applicable state statutes. Purchasers are responsible for complying with the laws of their state of residence.
4. Background Check Requirements
All firearm transfers must be conducted through a licensed FFL dealer. The transferring FFL is responsible for completing ATF Form 4473 and initiating a National Instant Criminal Background Check System (NICS) inquiry prior to transfer. BDG is not responsible for delays caused by NICS proceedings. If a background check is denied, the firearm will not be transferred and the purchase may be subject to a restocking fee.
5. FFL Transfer Requirement
BDG does not transfer firearms directly to consumers. All firearm orders must be shipped to a federally licensed FFL dealer of your choosing, who will complete the required transfer paperwork. You are responsible for:
- Selecting a valid FFL dealer to receive your firearm
- Providing BDG with a signed copy of the receiving FFL's license prior to shipment
- Paying any transfer fees charged by the receiving FFL
- Completing all required federal, state, and local paperwork at the receiving FFL
BDG reserves the right to refuse shipment to any FFL for any reason.
6. Product Descriptions & Accuracy
We make every effort to accurately describe our products, including specifications, materials, and finishes. However, we do not warrant that product descriptions, specifications, or other content on our website are accurate, complete, current, or error-free. Product specifications may change without notice. Images are for illustrative purposes and actual products may vary slightly in appearance.
7. Pricing & Payment
All prices are listed in U.S. dollars and are subject to change without notice. BDG reserves the right to cancel any order in the event of pricing errors. Payment is due in full at the time of purchase. Accepted payment methods are displayed at checkout. Orders are not confirmed until payment is processed and funds are verified.
You represent that you are authorized to use the payment method provided and that charges incurred will be honored by your financial institution. Any chargebacks initiated fraudulently may result in civil or criminal liability.
8. Prohibited Uses
You agree not to use BDG's website or products for any unlawful purpose, including but not limited to:
- Purchasing firearms on behalf of a person who cannot legally purchase firearms (straw purchases)
- Converting any semi-automatic firearm to fire automatically without proper ATF licensing
- Acquiring any product with intent to circumvent applicable firearms laws
- Purchasing from a state or jurisdiction where the product is prohibited
- Reselling without required federal or state licensing
Straw purchases are a federal felony under 18 U.S.C. § 922(a)(6). BDG will cooperate fully with law enforcement investigations.
9. Disclaimer of Warranties
All products are sold "as is" and "as available" to the maximum extent permitted by applicable law, unless otherwise specified in writing. BDG makes no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, except as required by law. Product warranties, if any, are provided by the manufacturer and are subject to the manufacturer's terms.
10. Limitation of Liability
To the fullest extent permitted by Colorado law, BDG's total liability arising out of or related to these Terms or any purchase shall not exceed the amount paid by you for the specific product giving rise to the claim. In no event shall BDG be liable for indirect, incidental, consequential, special, or punitive damages. Some states do not allow certain limitations of liability; those limitations may not apply to you.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising from these Terms or any purchase shall be resolved in the state or federal courts located in Douglas County, Colorado. You consent to personal jurisdiction in those courts.
12. Export Controls
All products sold by BDG are subject to U.S. export control laws and regulations, including the Export Administration Regulations (EAR) and the International Traffic in Arms Regulations (ITAR). By purchasing from BDG, you represent that you will not export, re-export, or transfer any product to any country, person, or entity prohibited by U.S. law without obtaining prior written government authorization.
